Terms of Service

1. Agreement to Terms

By accessing or using Vibe Computing (vibecomputing.ai) ("the Service"), operated by Techimbue FZE, a company registered in Dubai, United Arab Emirates (together with its parent, subsidiaries, and affiliated entities, "we", "us", "our", or "Techimbue"), you agree to be bound by these Terms of Service. If you disagree with any part of the terms, you may not access the Service.

2. Description of Service

Vibe Computing is an AI-powered infrastructure management platform that allows users to manage servers, virtual machines, and cloud resources through natural language interfaces. The Service includes:

  • AI-assisted command execution on connected systems
  • Cloud resource provisioning (AWS, Azure, Hetzner, etc.)
  • Agent software for connecting self-managed servers
  • LLM data obfuscation features
  • Related APIs and integrations

3. User Responsibilities

You agree to:

  • Provide accurate registration information
  • Maintain the security of your account credentials
  • Not use the Service for any illegal purposes
  • Not attempt to gain unauthorized access to systems
  • Not use the Service to harm, harass, or violate the rights of others
  • Comply with all applicable laws and regulations
  • Only connect systems that you own or have explicit authorization to manage

4. Acceptable Use Policy

You may NOT use Vibe Computing to:

  • Execute malicious code, malware, or viruses
  • Perform denial-of-service attacks
  • Mine cryptocurrency without explicit authorization
  • Host or distribute illegal content
  • Violate intellectual property rights
  • Engage in fraudulent activities
  • Access or manage systems you don't have permission to control

We reserve the right to suspend or terminate accounts that violate these policies without prior notice.

5. Payment Terms

For paid plans:

  • Subscription fees are billed monthly or annually in advance
  • Fees are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • Usage-based charges (if applicable) are billed in arrears
  • Failed payments may result in service suspension

6. Data, Security & Assumption of Risk

You use the Service entirely at your own risk. The Service executes commands that you or the AI authorize against systems you connect. Such commands can modify, delete, or expose data and can render systems inoperable. While we implement industry-standard security measures:

  • You are solely responsible for securing your connected systems and for reviewing commands before execution, especially in production environments
  • To the maximum extent permitted by law, we are not liable for any data loss, data corruption, data destruction, or data leakage or exposure arising from or related to your use of the Service, including command execution
  • The Service transmits data to third-party AI/LLM providers. LLM data obfuscation reduces but does not eliminate the risk of sensitive data being exposed to those providers, and we are not liable for such exposure
  • You are responsible for maintaining your own backups; we do not guarantee recovery of any data
  • We recommend using your own LLM API keys and testing in non-production environments for sensitive workloads

On-premise carve-out. The risk allocation and liability limitations in this Section and in Section 8 do not apply to a deployment that Techimbue FZE installs, hosts, and operates on-premise for a customer under a separate signed agreement. Any such deployment is governed exclusively by that agreement.

7. Third-Party Services

The Service integrates with third-party providers including:

  • Cloud providers (AWS, Azure, Hetzner, etc.)
  • AI/LLM providers (Anthropic, OpenAI)
  • Payment processors (Stripe)

Your use of these services is subject to their respective terms of service.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TECHIMBUE FZE, ITS PARENT, SUBSIDIARIES, AND AFFILIATED ENTITIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS (COLLECTIVELY, "TECHIMBUE"), TOGETHER WITH THE VIBE COMPUTING SERVICE, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

WITHOUT LIMITING THE FOREGOING, WE ARE NOT LIABLE FOR ANY DATA LOSS, DATA CORRUPTION, OR DATA LEAKAGE OR EXPOSURE (INCLUDING VIA THIRD-PARTY LLM PROVIDERS), SERVICE INTERRUPTION, OR DAMAGE TO ANY SYSTEM, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. YOU USE THE SERVICE AT YOUR OWN RISK.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

These limitations do not apply to on-premise deployments operated by Techimbue FZE under a separate signed agreement, as described in Section 6.

9. Indemnification

You agree to indemnify and hold harmless Vibe Computing, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

10. Service Availability

We strive for high availability but do not guarantee uninterrupted access. We may:

  • Perform scheduled maintenance with reasonable notice
  • Suspend service temporarily for emergency maintenance
  • Modify or discontinue features with 30 days notice

11. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Violation of these Terms
  • Non-payment of fees
  • Fraudulent activity
  • At our sole discretion with 30 days notice

Upon termination, you must disconnect all agents and cease using the Service.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Dubai, UAE.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
